In June of 2016, a woman called Miss Kelly spoke to an experienced community psychiatric nurse she was planning to end her life. She was not willing to be detained by the Mental Health Act but agreed to an assessment of treatment at home. The assessor, however, was concerned that she was a danger to herself or others. She did not believe she was competent enough to consent.
The assessor then suggested that Miss Kelly should be detained against her wishes. Miss Kelly didn't want to be in a ward, so she called Dr Ramanathan Elayaperumal, her psychiatrist. He was a consultant psychiatrist at the Home Treatment Team of Essex Partnership NHS Foundation Trust.
In response to the suggestion that was made, the Home Treatment Team performed a comprehensive assessment of Miss Kelly's current health and mental state. The evaluation included a thorough medical history and physical examination. The review also included a thorough psychotherapy assessment, a family therapy assessment and a psychiatric diagnosis interview.
According to the report Miss Kelly was suffering from a variety of mental health issues, such as bipolar disorder, bulimia, and anorexia. She was also abused by her husband and was an addict to drugs. Her symptoms were exacerbated by anxiety, stress and depression. She was also diagnosed with bipolar affective disorder as well as schizoaffective disorder.
Elayaperumal claims that Medtronic intentionally did not treat him fairly due to his race and national origin. He claims that his poor performance review in June of 2000 and the refusal to award him certain assignments were influenced by racism. Medtronic has not provided any evidence that its decisions were based upon these factors. Furthermore, Elayaperumal's less-than-perfect performance review did not result in an increase in his compensation, benefits, or the responsibilities he had.
